Having signed the Association Agreement between the European Union and the European Atomic Energy Community and their member states, of the one part, and Ukraine, of the other part that was ratified by the Verkovana Rada of Ukraine in September, 2014 Ukraine has taken a commitment to ensure a high level of consumer protection and to achieve consistency between the consumer protection systems of Ukraine and the EU.
In accordance with the obligations stipulated in the Association Agreement, legislative acts of the European Union that are defined in Annex XXXIX to the Agreement, shall be implemented to the national legislation within three years from the date of entering into force of this Agreement.
For this purpose the Ministry of Economic Development and Trade has developed a draft Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine (On Consumer Rights Protection)", registered in the Verkhovna Rada of Ukraine on December 16, 2016, No. 5548 (hereinafter - Draft 5548).
Draft 5548 proposes, among other things, to determine consumer rights in case of prepayment for goods; eliminate duplication of control functions of consumer protection and state market surveillance bodies, bodies responsible for food safety, bodies responsible for the safety of services (works); eliminate duplication of responsibilities of business entities in the field of ensuring the safety of non-food products, services (works).
At the meeting of the Committee of the Verkhovna Rada of Ukraine on economic policy dated March 21, 2018, the Draft 5548 was considered and it was decided to recommend to the Verkhovna Rada of Ukraine to adopt it in the first reading as a basis.
Also, the Resolution of the Cabinet of Ministers of Ukraine dated March 10, 2017 No. 136 "On Amendments to the Procedure for the conduct of trade activities and rules of trade in the consumer goods market", which takes into account the provisions of Directive 87/357 / EEC.
The above-mentioned resolution introduced amendments to the Procedure for the conduct of trade activities and rules of trade in the consumer goods market, in particular, in relation to the prohibition of the sale of goods imitating food products and endangering health and safety of consumers, especially children.
The Ministry of Economic Development and Trade amended the Rules of Retail Trade of Non-food Products in order to take measures for the removal from the market non-standard lighters that make a high risk of improper use by children (injuries, burns, fires), prevention of possible violation by business entities selling non-food products, including lighters, as well as providing realization of consumer rights in case of purchase of goods of inadequate quality.
The Order of the Ministry of Economic Development of Ukraine "On Amendments to the Rules of Retail Trade in Non-food Products" dated January 23, 2018 No. 80 was registered by the Ministry of Justice on February 15, 2018 under No. 181/31633, taking into account the provisions of Commission Decision 2006/502 / EC dated May 11, 2006, requiring Member States to take steps to ensure that only lighters protected from the possible use by children are placed on the market and that the placing of non-standard lighters on the market is prohibited.
Also, the Ministry of Economic Development and Development has developed and the Government has approved the Concept of the state policy in the field of consumer rights protection up to 2020, the purpose of which is to create and implement an effective system of consumer rights protection in Ukraine on the basis of the EU, taking into account the best practices of the countries in the European Union (the Decree of the Cabinet of Ministers of Ukraine on March 29, 2017, No. 217-p).
The Decree of the Cabinet of Ministers of Ukraine dated December 27, 2014 No. 983-p approved the Action plan for the implementation of the Concept of state policy in the field of consumer rights protection up to 2020.
On April 20, 2018, the All-Ukrainian Forum "Protected Consumer - Competitive Business - European Choice of Ukraine" was chaired by the First Deputy Prime Minister of Ukraine, the Minister of Economic Development and Trade of Ukraine. Kubiv S.I., in order to consolidate the efforts of the state, public sector and business in overcoming the outdated approaches to consumer protection and building an effective system of consumers' rights protection.
This forum became a platform for conducting an all-Ukrainian dialogue between authorities, business associations and consumer organizations.
